Terms and Conditions (Offer)

This public offer (hereinafter referred to as the “Offer”) is prepared in accordance with paragraph 2 article 437 of the Civil Code of the Russian Federation and applies to any Event Ticket Customer and/or Parking Permit Customer and/or Gift Certificate Customer, who wishes to purchase Event Tickets and/or Parking Permits and/or a Gift Certificate, as well as to any Event Ticket Holder who wishes to attend the Event and who is in possession of an Event Ticket.

This Offer defines the terms of booking, issuing, purchase, exchange and refund of the Event Tickets, Event Ticket Purchase Confirmations/Gift Certificates and/or Parking Permits for the Event Ticket Customer and/or Parking Permit Customer, as well as the rights and obligations of the Event Ticket Holder and/or Parking Permit Holder/Passenger when attending the Event/ Parking area.

The Customers/Holders of Event Ticket Purchase Confirmations, Gift Certificates, Event Tickets and/or Parking Permits/Passengers are strongly encouraged to read and inform themselves of these Offer Conditions. By attending the Event, remaining at the Parking area, purchasing an Event Ticket Purchase Confirmation, Event Ticket and/or Parking Permit, entering into and/or remaining at the Venue/Parking area, each Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer/Holder and/or Parking Permit Customer/Holder is deemed to have accepted and understood as binding on them, all Offer Conditions and any accompanying obligations and responsibilities.

These Offer conditions are available at the Official Event website (f1.sochiautodrom.ru), at Authorised Box Offices (indicated at the Official Event website) or by calling the call center at 8 800 222 00 70, +7 (499) 495 13 74.

1. Definitions and Interpretation

1.1. For the purpose of literal interpretation of these Offer Conditions, the following definitions are set:

“Offer Conditions” means the conditions, set out in this Offer that can be amended or modified from time to time, including, but not limited to, publication on the Official Event Website www.f1.sochiautodrom.ru.

“Event Ticket Customer” means an individual and/or entity who has turned to the Promoter or an entity representing the Promoter’s interests with the purpose of buying, issuing, exchange, refund and/or re-issue of a lost or stolen Event Ticket.

“Event Ticket Holder” means a person in possession of a valid Event Ticket, including an Event Ticket Customer, to enter the Venue.

“Customer of Event Ticket Purchase Confirmation” means an individual and/or entity who has applied to the Promoter or an entity representing the Promoter’s interests with the purpose of buying, issuing, exchange or refund of an Event Ticket Purchase Confirmation.

“Holder of Event Ticket Purchase Confirmation” means a person in possession of a valid Event Ticket Purchase Confirmation, including a Customer of Event Ticket Purchase Confirmation.

“Parking Permit Customer” means an individual who has applied to the Promoter or an entity representing the Promoter’s interests with the purpose of buying or refund of a Parking Permit.

“Parking Permit Holder” means a person in possession of a valid Parking Permit, including a Parking Permit Customer.

“Event Ticket” means a document containing the relevant Event Ticket information (conditions) in compliance with the current legislation of the Russian Federation and a unique barcode, certifying the right of an Event Ticket Holder or any other person presenting an Event Ticket, to attend the Event.

“Event Ticket Purchase Confirmation” means a document, which does not certify the right to attend the Event, which is subject to exchange for an Event Ticket.

“Parking Permit” means a document with a unique serial number, which certifies the right of a Parking Permit Holder to park in the unguarded parking areas, specified on the Official Event Website, specifically: entry, exit and parking of a vehicle from 7:00 a.m. till 23:00 p.m. over the period from 28 September 2018 through 30 September 2018.

“Gift Certificate” means a document with a unique serial number, which certifies the right of its holder to set off its face value or a part of it when purchasing an Event Ticket Purchase Confirmation/an Event Ticket/a Parking Permit.

“Event” means motor races as well as training, qualifying races and/or warm-ups before such races and activities that precede the FORMULA 1 2018 VTB RUSSIAN GRAND PRIX that will take place in Sochi, Imeretinskaya lowland, in the period between the 27 and 30 of September 2018.

“Promoter” means ROSGONKI autonomous non-profit organisation for the popularisation and development of motorsport (ANO “ROSGONKI”), (TIN 7730240248, PSRN 1177700021388, legal address: 1 Vasilisy Kozhinoy street, Moscow, Russia 109028.

“Event Ticket Face Value/ Face Value of Event Ticket Purchase Confirmation” meansa sum of money corresponding to the value of the Event admission fee set by the Promoter for all third parties, indicated on the Event Ticket/ Event Ticket Purchase.

“Parking Permit Face Value” means a sum of money corresponding to the value, including 18% VAT, of the Parking Permit for the relevant vehicle, set by the Promoter for all third parties.

“Additional payments” means payments associated with the purchase of an Event Ticket and/or Parking Permit, including delivery, if the Event Ticket Customer and/or Parking Permit Customer agrees on the Event Ticket and/or Parking Permit delivery, service charges, acquiring, as well as for Visa and/or Mastercard payment, including 18% VAT.

“Official Event Website” means a combination of information resources located on the Internet at www.f1.sochiautodrom.ru and published by the Promoter for general public with the purpose of providing actual and accurate information on the Event.

“Venue” means the circuit for the highway-ring motor racing of Formula 1 series in Imeretinskaya Lowland and infrastructure facilities that ensure its operation, which belongs to the Principal, as well as all areas in, around and within the circuit, which are used in any manner connected with staging of the FORMULA 1 2018 VTB RUSSIAN GRAND PRIX and/or is intended for other supporting events.

"Parking area" means a special open unguarded site, located in the areas, specified on the Official Event Website, which is intended for temporary parking of vehicles of Parking Permit Holders from 7:00 a.m. till 23:00 p.m. over the period from 28 September 2018 through 30 September 2018.

"Vehicle" means a category B vehicle (a car) and/or a vehicle, which length exceeds 5 meters and passenger capacity exceeds 8 people (a bus).

"Passenger" means a person, which is or was inside a vehicle in the Parking area, apart from the Parking Permit Holder.

“Force Majeure” means extraordinary, unavoidable circumstances under the given conditions such as natural disasters, military actions, etc.

“Associated Entities” means Federation Internationale de l’Automobile (FIA), Formula One World Championship Limited (FOWC), Formula One Management Limited (FOML), Title Sponsor (if any), any suppliers, organisers, promoters, entities and persons involved in the organisation, staging and promotion of the Event.

1.2. For the purpose of the present Offer, except for the cases when the context stipulates otherwise:

(a) words utilizing the singular shall include the plural and vice versa;

(b) words importing a specific gender shall include the other genders (male, female or neuter);

(c) the headings are for convenience only and do not affect interpretation;

(d) a reference to a “Clause” is a reference to a clause of these Offer Conditions;

(e) reference to the Offer includes all amendments or supplements to the present Offer, published at the Official Event Website.

2. General conditions

2.1. In case of adverse weather conditions, the Event may be cancelled in its entirety and/or a part of the Event may be postponed or cancelled at the Promoter’s discretion. Information on cancellation or postponement of the Event (or any part of it) will be published by the Promoter on the Official Event Website.

2.2. Each Event Ticket Holder is aware, agrees, accepts and acknowledges that the Venue is a dangerous place and that certain Events and activities associated therewith are dangerous and accidents can happen. By attending any Event, entering into and/or remaining at the Venue or Parking Area each Event Ticket Holder and/or Parking Permit Holder/Passenger is deemed to have accepted this Offer and any accompanying risks, obligations and responsibilities. Each Event Ticket Holder and/or Parking Permit Holder/Passenger is warned that there is a possibility of an accident causing injury, death or property damage or loss and attending any Event, entering into and/or remaining at the Venue or Parking area is solely at the Event Ticket Holder’s and/or Parking Permit Holder’s/Passenger’s own risk and that they assume such risk. Each Event Ticket Holder and/or Parking Permit Holder/Passenger acknowledges that the risks associated with attending or participating in any Event, entering into and/or remaining at the Venue or Parking area includes the risk of suffering harm as a result of motor vehicles (or parts of them) colliding with other motor vehicles, persons or property. Each Event Ticket Holder and/or Parking Permit Holder/Passenger agrees, accepts and acknowledges that attending any Event, entering into and/or remaining at the Venue orParking area has a degree of danger and, to the extent permitted by the Russian Federation law, hereby excludes, releases and forever discharges the Promoter and/or the Associated Entities and each of them, from any and all liability for claims, loss, damage, cost or expenses, incurred by the Event Ticket Holder and/or Parking Permit Holder/Passenger, arising from his/her personal injury or death. The Event Ticket Holder and/or Parking Permit Holder/Passenger bears responsibility for any Event Ticket Holders and/or Parking Permit Holders/Passengers under 18 years of age under his/her supervision when at the Event/in the Parking area.

2.3. The Promoter reserves the right to change the Parking area for the Parking Permit Holders for another Parking area, in case the dedicated Parking area is not available.

2.4. Official merchandise is on sale inside the Venue. Event Ticket Holders and/or Parking Permit Holders/Passengers must not buy from unofficial vendors. No goods (including literature) of any nature may be offered either free or for sale by any person within the Venue or any official Parking area by any party, which does not have a proper permit to do so.

2.5. Save for official merchandise and other motor sport related clothing worn in good faith, it is forbidden to bring into, use or display within the Venue or Parking area any sponsorship, promotional or marketing materials.

2.6. Where available, the Promoter will provide mobility impaired individuals (wheelchair users), which hold an Event Ticket, with appropriate accessible seating for the Event, subject to availability. Should an Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate Customer require accessible seating, he/she should contact the call center to discuss the conditions of purchasing an Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate for such seating category.

2.7. Some areas at the Venue and the Parking area are exposed to direct sunlight, rain and wind. Each Event Ticket Holder and/or Parking Permit Holders/Passengers is required to take appropriate care for their wellbeing and protection from such weather conditions.

2.8. While at the Venue or in the Parking area, the Event Ticket Holder and/or Parking Permit Holder/Passenger must maintain safe, prudent and respectful behavior and comply with all security measures and instructions given by the Promoter or any other entities acting with consent of the Promoter.

2.9. Description of the Event, date, time, location and prices of the Event Tickets and/or Parking Permits are provided on the Official Event Website in the section dedicated to the Event.

2.10. Children under 3 (three) years of age are granted free access to the Event. Thus children under 3 (three) years of age cannot occupy a separate seat without a separate Event Ticket purchased. In order to confirm that a child is under 3 (three) years of age so that he/she can be granted free access to the Event, an adult (next of kin, guardian) accompanying a child who is under 3 (three) years of age shall demonstrate the child’s Birth Certificate upon entry to the Event.

2.11. The Promoter shall provide the possibility to buy a Child Event Ticket for Main Grandstand, T1 Grandstand, Т2 Grandstand, T3 Grandstand, T4 Grandstand for children aged between 3 (three) and 12 (twelve) years at the time of the Event subject to availability. There is a condition that a maximum of 2 (two) Child Event Tickets for Main Grandstand level 2, T1 Grandstand, T3 Grandstand, T4 Grandstand are available for purchase per 1 (one) Adult Event Ticket for Main Grandstand, T1 Grandstand, Т2 Grandstand, T3 Grandstand, T4 Grandstand. In order to confirm that a child is eligible for a child’s ticket, an adult (next of kin, guardian) accompanying the child who is under 12 (twelve) years of age shall demonstrate the child’s Birth Certificate upon entry to the Event.

2.12. Mobility impaired individuals (wheelchair users) if unable to attend the Event by themselves have the right when buying an Event Ticket to request one free Event Ticket for a companion through the call center щк at Authorised Box Offices. The companion will be provided with a free Event Ticket only if there is a seat available in the same category as indicated on the Event Ticket purchased by the Event Ticket Customer (wheelchair user). A companion ticket to the event can be sold only together with a wheelchair ticket

2.13. A Parking Permit grants access to the Parking area for a Parking Permit Holder/Passenger only for the purposes of parking Vehicles. A Parking Permit is valid only during the period indicated on it, however in the event of any changes to the Event timetable the Parking Permit validity period may be changed.A Parking Permit does not grant the right to attend the Event.

2.14.A Gift Certificate can be purchased by contacting the call center or on the official website at f1.sochiautodrom.ru

After the purchase of a Gift Certificate is completed and it is paid for via the call center or the official website, the customer can view and print it in his personal account.

If a Gift Certificate is lost, damaged or expires, it cannot be re-issued.

2.15. A Gift Certificate can be used to purchase an Event Ticket Purchase Confirmation/ an Event Ticket and/or a Parking Permit.

It’s possible to use the full face value of a Gift Certificate to purchase an Event Ticket Purchase Confirmation/ an Event Ticket and/or a Parking Permit or its part.

If the face value of a Gift Certificate is not enough to purchase the Event Ticket Purchase Confirmation/ Event Ticket and/or Parking Permit selected, it is possible to pay the remaining amount by cash or by card.

A Gift Certificate does not give the right to attend the Event.

3. Validity of the Offer

3.2. Event Tickets and Parking Permits shall be sold until 5 pm 30 September 2018, inclusive.

4. Personal data

4.1. In accordance with the Federal law dated 27.07.2006 № 152-FZ “On Personal Data”, by accepting this Offer (concluding the agreement) a Customer of Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate Customer and/or Parking Permit Customer agrees that his or her personal data becomes public when the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer provides his or her personal data by specifying it on the Official Event Website or other internet resource indicated on the Official Event website, or in any other way (at Authorised Ticket Box Offices, to a call center operator, etc.).

The Promoter shall have the right to use public personal data of the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer for the purposes of marketing emails and for any other purposesnecessary to execute its obligations in respect of the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer in accordance with this Offer.

4.2. An Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer fully agrees that f Event Ticket Purchase Confirmations/ Event Tickets/Gift Certificates and/or Parking Permits were purchased through the Official Event Website or another Internet resource, indicated on the Official Event Website,the Promoter reserves the right, notifying the Event Ticket Purchase Confirmation/ Event Ticket/Gift Certificate and/or Parking Permit Customers on the indicated website through which the purchase was made, to oblige theEvent Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customerto provide additional information containing personal data.

5. Responsibilities of the parties

5.1. For non-performance or improper performance of the obligations under the Offer the Parties shall bear responsibility according to the applicable legislation of the Russian Federation.

5.2. The Promoter shall not be responsible for ensuring sufficient Event Tickets and/or Parking Permits inventory across the various price categories.

5.3. The Promoter shall not be responsible for ensuring the conformity of the Event to the expectations of the Event Ticket Holder.

5.4. The Promoter shall not be responsible and shall not reimburse a Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer for any losses or failures, owing to Ticketing system malfunction or temporary lack of connection to the system, which prevent the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer from purchasing Event Ticket Purchase Confirmations/ Event Tickets/Gift Certificates and/or Parking Permits.

5.5. A Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer shall be fully responsible, in accordance with the current legislation of the Russian Federation for any consequences, arising out of the provision of inaccurate or knowingly false information to the Promoter or to a third party, which represents the Promoter, as well as for any violation of rights and interests of other persons arising out of such actions.

5.6. The Parties shall not bear responsibility for non-performance or improper performance under the Offer Conditions, which is caused by circumstances beyond ones reasonable control (Force Majeure).

5.7. A Event Ticket/Gift Certificate and/or Parking Permit Customer/ Holder cannot, without the written consent of both the Promoter and FOWC, resell, transfer (for commercial or other personal gain) or distribute any Event Ticket(s) and/or Parking Permits (above the Face Value specified on the Event Ticket and/or the Parking Permit), a Gift Certificate or buy, or purchase Event Ticket(s) and/or Parking Permits from / or through a reseller who is not the Promoter or not a Promoter’s authorized agent.

5.8. The Promoter accepts no responsibility for stolen or counterfeit Event Tickets and/or Parking Permits/Gift Certificates purchased or obtained through unauthorized sources. Event Ticket Holders and/or Parking Permit Holders who are found to be in possession of Event Tickets and/or Parking Permits that are counterfeit or have been reported as lost or stolen will be denied entry to the Event and/or Parking area.

5.9. Event Tickets and/or Parking Permits/Gift Certificates may not be used for advertising, promotional or commercial purposes including prizes, competitions, contests or sweepstakes, or packaged with hospitality products (including but not limited to food and beverage, transfers, accommodation, merchandise etc.), except with the prior written consent of both the Promoter and FOWC.

5.10.The Promoter reserves the right to refuse admission to (or eject from) the Venue, Parking Area any Event Ticket Holder and/or Parking Permit Holderwho is in possession of an Event Ticket and/or a Parking Permit which has been sold or used in a manner which does not comply with these Offer Conditions.

5.11.Persons under the age of 18 (eighteen) years may only attend the Event or Parking Area when accompanied by a guardian.

5.12.No person may use the name of the Event or part thereof (nor any abbreviation or foreign language version thereof) nor any trademarks of the Promoter and Associated Entities, logo or graphic device of or relating to the Event for any commercial purpose whatsoever.

5.13.A Event Ticket Purchase Confirmation/Event Ticket/Parking Permit and/or Parking Permit Holder is solely responsible for complying with all immigration, customs and legal requirements of any relevant authority for entry into the territory of the Russian Federation (including, but not limited to, obtaining an entry visa or permit of any kind). In relation to an Event, no exchanges, refunds or replacements of an Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit will be made due to the failure of the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Holder to comply with such requirements, or his or her inability to obtain (or his or her denial, cancellation, expiration or revocation of) an entry visa or permit, for any reason whatsoever.

5.14.Each Event Ticket Holder/ Parking Permit Holder and/or Passenger agrees to compensate the Promoter and/or the Associated Entities for any and all damage, loss, liability or injury that they suffer as a result of the failure of the Event Ticket Holder/ Parking Permit Holder and/or Passenger to comply with these Offer Conditions or the willful, reckless or negligent acts or omissions of the Event Ticket Holder/ Parking Permit Holder and/or Passenger, or any person within the care, guidance or supervision of the Event Ticket Holder/ Parking Permit Holder and/or Passenger, within the Venue or Parking Area.

5.15. Parking Permit Holder agrees that only Vehicles displaying a valid Parking Permit will be able to gain entry to the Parking area.

5.16. A Parking Permit Holder/Passenger agrees that all Vehicles (and their contents) parked within any Parking area operated by the Promoter are left at the Parking Permit Holder's/Passenger's sole risk.The Promoter shall not be liable for any loss or damage to a Vehicle (including its contents) arising from the use of any Parking area by a Parking Permit Holder/Passenger.

5.17. When obtaining a Parking Permit, the Parking Permit Holder/Passenger agrees to observe the regulations, terms and conditions established by the Promoter in relation to the Parking areas and the Venue itself.

5.18. An Event Ticket Holder and/or Parking Permit Holder/Passenger undertakes to follow safety regulations and instructions of the Promoter's personnel whilst in the Parking area (either when driving a Vehicle or on foot). The Promoter reserves the right to withdraw the Parking Permit and refuse admission and/or eject from the Parking area any person(s) found in breach of the Conditions of this Offer.

5.19.Each Event Ticket Holder and/or Parking Permit Holder/ Passenger must not without the prior written consent of the Promoter:

(a) be on the Venue outside of the Event period (gates opening and closing time will be published on Official Event Website);

(b) leave the Venue or Parking area other than through a designated exit;

(c) remove any fence or cordoned off area, or interfere with any activity undertaken in any fenced or cordoned off area;

(d) erect any structure, or erect or display any sign or banner etc. at the Venue and/or Parking area;

(e) post, stick or place any poster, placard, bill, banner print, paper or any advertising material on any building, structure, fence, tree or cordon at the Venue and/or Parking area;

(f) distribute any printed or visual matter or distribute, display or promote any advertising or promotional material, samples of goods or services or any other matter or thing at the Venue and/or Parking area;

(g) distribute, hawk, sell, offer or expose for sale any goods or services of collect money or orders for goods and services at the Venue and/or Parking area;

(h) sell, offer or make available for sale any Event Ticket and/or Parking Permit above its Face value, indicated on the Event Ticket and/or Parking Permit;

(i) misuse, deface, damage, or tamper with any building, seat, chair, table, structure, vehicle, vessel, truck, pipe, tap, tap-fitting, conduit, electrical equipment, wiring, or signs at the Venue and/or Parking area;

(j) block any thoroughfare to the Venue or Parking area;

(k) deposit litter, except in a receptacle provided for that purpose;

(l) throw or kick any stone, bottle or other projectile;

(m) disrupt, interrupt or behave in any manner that may disrupt or interrupt any race, event or activity;

(n) act or conduct oneself in such a way as to hinder, obstruct or interfere with a driver of any vehicle taking part in a race or to adversely affect the safety of the public;

(o) use indecent or obscene language or threatening or insulting words or otherwise behave in a threatening, riotous, indecent or insulting manner;

(p) operate or use a loud hailer, public address system, broadcast device or other device which may interfere with electronic or radio communications being used by the Promoter, Associated Entities, Event participants or other persons authorized by the Promoter;

(q) smoke in non-smoking areas;

(r) get to a grandstand or general admission area (in accordance with the Event Ticket purchased) with beverages in plastic, glass or metal containers (of any volume), except for plastic or paper cups, purchased at the designated sales points located at the Venue.

5.20. The Promoter and parties ensuring the safety of the Venue and the Parking area reserve the right to move any Vehicle they deem necessary for the reasons of safety of the Venue and the Parking area or for any similar reasons.

5.21. The Event Ticket Holder shall have the right to attend the Event during the days, indicated on the Event Ticket. At the same time, attendance of one day of the Event, if there’s no Promoter’s fault, shall be deemed as attendance of the whole Event.

5.22. On the day of the Event one Event Ticket is valid for one person only. Event Ticket transfer to another person throughout the day of the Event is prohibited.

5.23. One Parking Permit allows only one Vehicle of a certain category, indicated in the Parking Permit (either a car or a bus) into the Parking area. During the whole day, it is prohibited to hand over the same Parking Permit to be used by another Vehicle to access the Parking area.

5.24. A Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer has the right to buy not more than 10 (ten) Event Ticket Purchase Confirmations/ Event Tickets and 10 (ten) Parking Permits. In case of exceeding the limit by one person when buying Event Ticket Purchase Confirmations/ Event Tickets and/or Parking Permits the Promoter shall be entitled to cancel allEvent Ticket Purchase Confirmations/ Event Tickets and/or Parking Permitsthat exceed the limit specified in this Clause, with no compensation of cost. The number of Event Ticket Purchase Confirmations/ Event Tickets and/or Parking Permits to be sold may be increased by an agreement between the Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer and the Promoter.

5.25. The Promoter does not guarantee that several Event Ticket Purchase Confirmations/ Event Tickets within one particular order will be allocated with seats next to each other (in one row in succession).

6. Distribution of Event Information

6.1. By accepting this Offer, a Event Ticket Purchase Confirmation/ Event Ticket/Gift Certificate and/or Parking Permit Customer agrees that the Promoter or any third party acting with consent of the Promoter, may regularly distribute information, regarding the Event and/or any other Promoter’s offers, to the e-mail address and/or mobile phone number, indicated by the Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer while purchasing.

6.2. The volume and content of the information distributed as well as the dates and time of the distribution shall be established by the Promoter in its absolute discretion.

6.3. An Event Ticket Purchase Confirmation/Event Ticket/Gift Certifficate and/or Parking Permit Customer shall have the right, at any time to opt out of such communications by sending an email notification to the Promoter according to the instructions, contained in the corresponding letter (newsletter).

7. Additional Services

7.1. The Promoter or any third party acting with consent of the Promoter may charge a Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer Additional Payments for the delivery of the Event Tickets and/or Parking Permits, acquiring, (as well as for Visa and/or Mastercard payments), and services relating to the purchase of the Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit. The Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer confirms the acceptance of such Additional Payments (indicated at the Official Event Website, other Internet resources also indicated at the Official Event Website, at Box Offices or in the call center), when making an order.

7.2. Each Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer who elects to have their Event Tickets and/or Parking Permits delivered by courier shall solely bear all courier, delivery and/or postal charges incurred in relation or ancillary thereto.

7.3. A physical address for the Event Ticket(s)/Parking Permits delivery must be provided at the time of booking and the Event Ticket Customer/ Parking Permit Customer or its duly authorized designee must be available to sign for and receive the Event Ticket(s)/ Parking Permits during the hours of courier delivery in their jurisdiction.

7.4. Changes to delivery address details may only be made by calling the call center. It is the sole responsibility of the Event Ticket Customer and/or Parking Permit Customer who has made the purchase to notify the Promoter of any changes prior to the Event Tickets and/or Parking Permits being dispatched.

7.5. The Promoter accepts no responsibility for any Event Tickets and/or Parking Permits lost or misplaced by the courier company or postal service.

7.6. Unless specifically stated otherwise, Event Ticket and/or Parking Permit prices do not include any goods or any services other than entry to the Venue/Parking area and/or attendance at the particular Event.

8. Special Conditions

8.1. Event Ticket Holders must not make, create, store, record or transmit any kind of sound recording, visual footage, audio-visual footage (further - Recording), as well as store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data (further - Data) of, at or in relation to the Event. It is forbidden to bring into the Venue any equipment that may enable the visitor to perform the aforementioned acts. Electronic devices (including still image cameras, mobile telephones and other handheld personal communication devices) are permitted within the Venue unless otherwise advised, provided that any Recording, Data and any image, including photographic images and any still pictures derived or capable of being derived from a Recording (further - Image) of the Event, recorded, stored and/or created at the Event are used for personal and non-commercial purposes only, which does not include social media.

8.2. Each Event Ticket Holder agrees that:

(a) the use of any Recording, Data or Image specified in Clause 8.1. of the Offer, for any form of advertisement, display, commercial gain or for any other purpose (except for private enjoyment) without the prior written consent of FOWC is strictly forbidden and will constitute a breach of the Offer for which the Event Ticket Holder will be liable;

(b) on request by the Promoter or FOWC an Event Ticket Holder shall assign to FOWC in writing the copyright and all other intellectual property rights in any Image or Recording that an Event Ticket Holder creates, makes, stores or records of, at or in relation to the Event;

(c) FOWC (and any third party authorized by FOWC from time to time) may use for the purposes of or in connection with any publication, exhibition or broadcast (including any advertising or promotional literature, campaign or material) in any media worldwide and approved by FOWC any still or moving picture images taken at the Event where such image includes any image of the Event Ticket Holder and/or Parking Permit Holder/Passenger and the Event Ticket Holder and/or Parking Permit Holder/Passenger waives any and all of his or her personality and privacy rights to the extent necessary to permit such use.

8.3. The Promoter reserves the right to refuse admission to (or eject from) the Venue and/or Parking areas any Event Ticket Holder and/or Parking Permit Holder/Passenger who violates the obligations listed at the Decree of the Government of the Russian Federation dated 16 December 2013 № 1156 “Adoption of the Rules of Conduct for Visitors at the Official Sporting Events”.

8.4. Hereby the Event Ticket Holder confirms that motor racing, the Event and certain activities associated therewith (including but not limited to the support events) are dangerous. The Promoter, sanctioning bodies, FOWC and its affiliates, including Formula One Management Limited, Formula One Licensing B.V., Formula One Asset Management Limited, FIA, Formula One Hospitality and Event Services Limited, Formula One Marketing Limited, persons involved in the organisation of the Event (including officials, marshals, rescue and medical staff), the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies), are not responsible for any loss or damage howsoever caused to the Event Ticket Holder or property of the Event Ticket Holder to the maximum extent permitted by the law of the Russian Federation (save that nothing in these conditions limits or excludes (i) liability for death or personal injury arising out of the negligence of any of the above mentioned parties, or (ii) any damage incurred by way of fraud or fraudulent misrepresentation by any of the above mentioned parties).

8.5. During the Event the noise level may be very loud. It is advised to wear hearing protection during the Event to reduce the risk of hearing damage.

8.6. Event Ticket Holder acknowledges and accepts that some seats may have restricted viewing or legroom and that natural or man-made obstructions in some areas may impede viewing. The Promoter reserves the right at its discretion to issue last minute changes to seating arrangements for an Event Ticket Holder, which may result in Event Ticket Holder(s) being assigned seats with obstructed views or restricted legroom. Should the Promoter issue any significant changes to an Event Ticket Customer’s reserved seating arrangements, the Promoter will notify the Event Ticket Holder directly of such changes and endeavor to provide alternative seating arrangements

8.7. Any Event Ticket(s) and/or Parking Permits purchased, sold or used in contravention of this Offer will be deemed void and may result in the following:

(a) denial of entry to the territory of the Event/Parking area;

(b) eviction from the Venue;

(c) cancellation of Event Ticket and/or Parking Permits with no refund.

9. refund and replacement PROCEDURE FOR Event Tickets, EVENT TICKET PURCHASE CONFIRMATIONS AND PARKING PERMITS AND GIFT CERTIFICATE TERMS OF USE

9.1. Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer may request a refund of the money for an Event Ticket Purchase Confirmation/ Event Ticket and/or Parking Permit in the following cases:

(a) Cancellation of the Event.

(b) Death of the Holder of Event Ticket Purchase Confirmation/ Event Ticket Holder and/or Parking Permit Holder.

(c) Sickness of the Holder of Event Ticket Purchase Confirmation/ Event Ticket Holder and/or Parking Permit Holder, not allowing him or her to visit the Event or use the Parking Permit for medical reasons.

(d) In any other cases, stipulated by the legislation of the Russian Federation.

9.2. Only the Face Value of the purchased Event Ticket Purchase Confirmations/ Event Tickets and/or Parking Permits can be refunded.

9.3. In case of a refund of Event Ticket Purchase Confirmations/Event Tickets and/or Parking Permits under the provisions set out in subclauses b-d clause 9.1, additional Payments will not be refunded.

9.4. A Gift Certificate cannot be refunded.
If the full or partial face value of the Gift Certificate is not used within the period specified on the Gift Certificate, the Gift Certificate becomes invalid. When a Gift Certificate is used for an amount less than its claimed face value, the remaining amount cannot be refunded and can only be used to purchase an Event Ticket Purchase Confirmation/an Event Ticket and/or a Parking Permit.

9.5. Only the Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer may request a refund for an Event Ticket Purchase Confirmation/ Event Ticket and/or Parking Permit.

9.6. To obtain the refund for the Event Ticket Purchase Confirmations/ Event Tickets and/or Parking Permits the Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer shall apply to an authorized Box Office (the list of which is available at the Official Website) or submit the request by registered mail (with delivery notification via the Russian Post) or by a courier mail to the Agent, OOO “CTS EVENTIM RU ”, at the following address: OOO “CTS EVENTIM RU ” office, 31A/1 Leningradskiy ave, Moscow, Russia 125284 not later than September 30th, 2018.

In all cases, the Customer of Event Ticket Purchase Confirmation/ Event Ticket Customer and/or Parking Permit Customer must provide:

- an application for a refund of the Event Ticket Purchase Confirmation/ Event Ticket and/or Parking Permit with indication of bank details of the account to which the refund shall be made. The form shall be available at the Official Event Website and at authorized Box Offices. All fields of the refund request form for the Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit; shall be filled out completely

  • original Event Ticket Purchase Confirmation, Event Ticket and/or Parking Permit if they were purchased in the official box offices (the Customer of the Event Ticket Purchase Confirmation, the Event Ticket Customer and/or the Parking Permit Customer should keep a copy of the Event Ticket Purchase Confirmation, the Event Ticket and/or the Parking Permit for his/her own personal records).
  • the receipt to prove the purchase in case an Event Ticket Purchase Confirmation was purchased in the official box offices,

In case of electronic Event Ticket Purchase Confirmation/electronic Event Tickets, a copy of the Event Ticket Purchase Confirmation/the Event Ticket may be provided.

- a copy of his/her passport, in caseof a refund of Event Ticket Purchase Confirmation/ Event Ticket and/or Parking Permit in accordance with the conditions set out in subclauses (b) and (c) clause 9.1. of the Offer:

- documents in confirmation of the fact of death or sickness of the Customer/Holder of the Event Ticket Purchase Confirmation/Event Ticket Customer/Holder and/or Parking Permit Customer/Holder

9.7. In case of approval of the refund of the Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit, the money shall be refunded to the Customer of the Event Ticket Purchase Confirmation/Event Ticket Customer and/or Parking Permit Customer as follows:

- in case of non-cash payment (by bank card) for the Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit the refund will be made to the bank account, which was used for purchasing the Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit.

- in case of cash payment for the Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit the refund will be made to the bank account which the Customer of the Event Ticket Purchase Confirmation/Event Ticket Customer and/or Parking Permit Customer indicates in the relevant Refund request form.

The refund shall be made within 10 (ten) calendar days since the Promoter’s receipt of the Refund request form as well as all the required documents and information.

9.8. The Promoter reserves the right to deny the refund of a Face Value of an Event Ticket Purchase Confirmation/Event Ticket and/or Parking Permit if it was purchased in violation of the Offer Conditions.

9.9. The Event Ticket Holder and/or Parking Permit Holder must keep their Event Tickets and/or Parking Permits safe, as a duplicate Event Ticket and/or Parking Permit may not be reissued if it is lost or stolen. A defaced or illegible Event Ticket and/or Parking Permit may also be deemed invalid.

9.10. In case the Promoter agrees to reissue a stolen or lost Event Ticket, the Promoter reserves the right to charge the Event Ticket Holder a fee for the re-issue of the Event Ticket. The Promoter reserves the right to deny the reissue of a General Admission Event Ticket (if applicable).

9.11. Parking Permits cannot be reissued or exchanged under any circumstances.

9.12. A Gift Certificate cannot be re-issued.

10. Event Safety

10.1. In order to ensure public safety, the Promoter reserves the right to ask the Event Ticket Holder and/or Parking Permit Holder/Passenger to leave the Event/Parking area at any moment for security reasons. Access to the Venue is forbidden after the end of the Event.

10.2. To ensure security whilst at the Venue, CCTV cameras will be used. A Event Ticket/Gift Certificate and/or Parking Permit Customer/Holder/Passenger agrees that footage taken of him/her for general security measures may be used for the purposes of general security or passed to the parties, ensuring security at the Venue/Parking area for use in any proceedings.

10.3. To ensure security whilst at the Venue/Parking area, the security personnel engaged by the Promoter have the right to search any person entering the Venue and their possessions/Vehicle entering the Parking area any items inside it without giving any reason whatsoever and, the Promoter also shall have the right to refuse entry to the Venue/Parking to any individual/Vehicle or eject from the Venue/Parking area any individual/Vehicle refusing to submit to such a search. No refund of the Event Ticket cost and/or Parking Permit cost will be made in this case.

10.4. No animals will be admitted to the Venue or any Parking area, except guide dogs

10.5. While at the Venue, the Event Ticket Holders must always keep to the designated paths and access all freestanding viewing areas with caution, using steps or path as appropriate.

10.6. While in the Parking area, Parking Permit Holders shall follow special signage, markings and proceed with caution when entering the Parking area and driving inside it.

10.7. An Event Ticket Holder cannot bring into the Venue and use the following items:

  • weapons of any type including self-defense weapons, ammunition, bladed articles, any other items that might be used as a weapon, explosives, poisonous, toxic or odorous substances, radioactive materials;
  • flammable and pyrotechnical substances or articles, (except for matches, pocket lighters), including air-horns, flares, fireworks, gas tanks, and any other items (chemicals) that might be used for production of pyrotechnic products or smokes;
  • other substances, items, articles, including self-made that can be used to produce smoke or fire, hypergolic liquids;
  • tools and articles including self-made that are not pyrotechnical and that are used for dispersion or diffusion of different substances (pneumatic crackers);
  • any flag or banner with dimensions exceeding 2.0 x1.5 m, including those with hollow flagpoles with flagpoles’ length exceeding 1.5 m and flagpoles’ diameter exceeding 2.5 cm, chairs, benches, stools, ice chests, helium filled balloons, balls of any type and size;
  • colorants;
  • wind instruments to produce sounds (including vuvuzelas and whistles), except for bugles and pipes;
  • alcoholic and non-alcoholic drinks of any kind, except for refreshing drinks in 0.5 L plastic containers, glass bottles or containers, food, except for baby food with the volume not exceeding 1 liter per baby (including soymilk, breast milk or cow’s milk, infant formulas and sterilized water, including those in glass containers, any other food, required for feeding children under 5 years of age).
  • narcotics, toxics or stimulators;
  • promotional extremist materials; materials containing nazi or extremist symbols or attributes;
  • technical equipment which can interfere with the staging of the Event or with its participants (laser devices, flashlights), radios, sound amplification tools;
  • bulky items that create inconvenience for other spectators, except with the consent of the Promoter to bring such items;
  • domestic animals (except for guide dogs supporting Event Ticket Holders with invalidity and/or Parking Permit Holders/Passengers with invalidity);
  • bicycles, scooters, skateboards and roller blades, fireworks, frisbees, musical instruments and (or) musical equipment, including alarm systems, sirens, whistles, electronic equipment or any other broadcast equipment.
  • kick scooters, including two- or three-wheeled, self-balancing electric vehicles (e.g. Segway);
  • suitcases or bags with the dimensions exceeding 40 x 40 x 45cm.

Adults carrying baby food may be asked to present it for inspection;

11. Dispute RESOLUTION PROCEDURE

11.1. Any dispute in relation to the explanation or application of this Offer will be resolved by the Parties by sending a complaint to the other Party. The complaint shall be considered within 10 working days of its receipt.

11.2. If the Parties do not come to an agreement, the dispute shall be resolved in court in accordance with the established procedure.

12. Final provisions

12.1. This Offer comes into force and effect upon publishing at the Official Event Website or other Internet site, indicated at the Official Event Website and is valid until 30 September 2018 (inclusive).]

12.2. The Promoter has the right to change this Offer at any time, but all changes shall be published and brought to public attention by publication at the Official Event Website. Changes to the Offer Conditions do not have a retroactive effect, which means they are not applicable to civil law relations that might have emerged before the publication of the changes.

12.3. If a Event Ticket Purchase Confirmation/Event Ticket/Gift Certificate and/or Parking Permit Customer/ Holder/Passenger violates any Offer conditions the Promoter shall have the right, to terminate the Offer at any time, without prior notification.

12.4. Amendments or variations of the Offer conditions are only valid and binding if made or confirmed by the Promoter and published on the Official Event Website.

12.5. Each of the provisions of these Offer is severable from the other(s). If any provision or part of a provision is or becomes invalid, unenforceable or illegal in any respect, such provision or part of such provision will be deemed invalid and will be deemed not to form part of these Offer. The remaining provisions or parts of such provisions will not be invalidated in any way.

12.6. These Offer conditions are available in both Russian and English. In the event of any inconsistency between the Russian and English versions of these Offer, the Russian version shall prevail.

12.7. These Offer conditions are governed by and construed, performed and enforced in all respects in accordance with the legislation of the Russian Federation.
